5. Orders, Pricing and Acceptance

All orders are subject to acceptance and availability. Prices may change without notice prior to order confirmation. A contract is formed only when an order confirmation is issued by us.

6. Delivery and Collection

We offer the following fulfilment methods:

6.1 Customer Collection

Where collection is selected, the Customer is responsible for collecting goods from the nominated depot or location stated in the order confirmation. Goods not collected within 14 days may be deemed forfeited and may be resold or otherwise disposed of. The Customer remains liable for payment.

The Customer is responsible for loading goods and inspecting them at the point of collection. Any shortages or damage must be recorded at the time of collection and notified in writing within 3 days.

6.2 In-House Delivery Service

Where we provide delivery using our own vehicles, delivery will be made to the address specified in the order. Delivery dates and times are estimates only and are not guaranteed unless expressly confirmed in writing.

Delivery is deemed complete when goods are delivered to the address provided and signed for or otherwise confirmed as delivered. Risk passes to the Customer upon delivery.

The Customer is responsible for ensuring suitable access, unloading facilities, and safe delivery conditions.

6.3 UK Mainland Courier and Pallet Delivery Service

Where goods are delivered via third-party courier or pallet networks:

Deliveries are typically kerbside only unless otherwise agreed in writing.

The Customer is responsible for arranging unloading from the delivery vehicle.

Delivery dates are estimates and may be subject to delay outside our control.

Risk in the goods passes upon delivery to the courier or pallet carrier.

We are not liable for delays caused by third-party carriers.

Any damage or shortages must be noted at the time of delivery and reported to us in writing within 3 days of receipt.

7. Risk and Ownership

Risk of loss or damage passes to the Customer upon delivery or collection (as applicable). Ownership of goods remains with us until full payment has been received.

If delivery is delayed due to the Customer, risk passes on the original delivery date.

8. Failure to Take Delivery

If the Customer fails to accept delivery or provide adequate instructions, we may:

Store the goods at the Customer’s expense; or

Resell the goods and charge the Customer for any shortfall and associated costs.

9. Cancellation and Consumer Rights

Consumers have the right to cancel orders within 14 days of delivery under the Consumer Contracts Regulations 2013.

To cancel, you must notify us in writing. Goods must be returned in original condition. Return costs and arrangements are the responsibility of the Customer unless otherwise agreed.

Refunds will be processed within 14 days of receipt of cancellation notice, subject to inspection of returned goods.

10. Warranty and Liability

We provide no warranties beyond those required by law. We are not liable for:

Indirect or consequential loss (including loss of profit)

Misuse or incorrect installation of products

Wear and tear or damage caused after delivery

Nothing in these terms limits liability for death or personal injury caused by negligence or any liability that cannot be excluded under UK law.

11. Complaints and Feedback

We welcome feedback. Complaints can be sent to sales@wctscaffold.co.uk with full details so we can investigate and respond.

12. Data Protection and Cookies

We process personal data in accordance with applicable UK data protection laws, including the UK GDPR.

13. Force Majeure

We are not liable for delays or failure to perform obligations caused by events beyond our reasonable control, including but not limited to transport disruption, supply chain issues, extreme weather, or industrial action.

These terms are governed by the laws of England, Wales, Scotland and Northern Ireland. Any disputes shall be subject to the jurisdiction of the courts of the United Kingdom.
